Fines issued to the owner for tenant breaking the rules

Property owners should always ensure that tenants are given a copy of the Conduct Rules of the estate or sectional title complex and that they are aware of how they must conduct themselves.

In the event that the managing agents issue a fine for something such as noise or breaking of the rules in the complex to a property owner, such fine will fall onto the tenant even though it appears on the levy statement for the owner.

Before a fine can be issued, proof of complaints or illegal breaking of rules must be provided. Video footage with a full report can be provided by the trustees, security guards or building manager. All accusation and complaints must be properly documented.

For example, if a neighbour complains about noise, the first person to be contacted is the building manager or security. They would then need to notify the managing agents with proof. A full report needs to be sent and forwarded to the agency as well as the owner before a fine can be levied. This is also the last resort after a verbal warning has already been issued.
